The US Government has moved with unprecedented speed to protect Haitians residing
in the United States since the stunning and traumatizing earthquake that struck
Haiti on January 12th 2010.
|
|
|
|
Temporary Protected Status (TPS) has been granted to undocumented Haitian immigrants
living in the United States on or before January 12, 2010 for the next eighteen months.

WHAT YOU NEED TO KNOW ABOUT TPS FOR HAITI IMMIGRANTS
|
|
|
- YOU CAN APPLY FOR A WORK CARD AND SOCIAL SECURITY
NUMBER.
- YOU CANNOT BE
DEPORTED AS LONG AS TEMPORARY PROTECTED STATUS (TPS) IS IN EFFECT.
- TPS HAS BEEN GRANTED FOR A PERIOD OF EIGHTEEN MONTHS;
AFTER WHICH THE US GOVERNMENT MAY ELECT TO EXTEND THE BENEFIT.
- You MUST register for Temporary Protected Status
(TPS).
- You MUST register on or before the DEADLINE
DATE OF JULY 20th 2010
- If you do not register, you will not be protected.
Historically, citizens of other countries that were granted TPS, and who did not
register during the initial registration period; have not been eligible to re-register
for TPS when the benefit was extended.
- HAITIANS WITH MOST TYPES OF
DEPORTATION ORDERS ARE ELIGIBLE TO APPLY FOR TPS. HAVE AN IMMIGRATION
ATTORNEY REVIEW YOUR DEPORTATION ORDER TO DETERMINE IF YOU CAN APPLY.
- HAITIANS WITH A FELONY
CONVICTION OR TWO MISDEMEANOR CONVICTIONS ARE NOT
ELIGIBLE TO APPLY. HAVE AN IMMIGRATION ATTORNEY REVIEW YOUR CRIMINAL HISTORY TO
DETERMINE IF YOU CAN APPLY.
- HAITIANS WHO ARE OUT OF STATUS CANNOT APPLY TO TRAVEL. BE VERY CAREFUL WHEN CONSIDERING
TRAVEL. GET LEGAL ADVICE IF YOU ARE UNSURE ABOUT YOUR STATUS.

HAITI IMMIGRANTS APPLYING FOR TEMPORARY PROTECTED STATUS
WHAT YOU NEED TO SUBMIT AND PROVE
|
|
- PROOF OF Haitian Citizenship or that you were
living in Haiti prior to the earthquake.
DOCUMENTS TO PROVIDE: A government
issued Haitian passport (valid or expired) and/or Haitian birth certificates issued
by the National Archives with translation are acceptable. If your birth certificate
is not from the National Archives submit the birth certificate you have with translation.
- PROOF you were physically present in the United
States on or before January 12th 2010.
DOCUMENTS TO PROVIDE: Consider
submitting the following types of documents: utility bills showing your name and
address, pay stubs and/or W2 or 1099 forms; Student ID, Bank statements, car and/or
health insurance information. It IS RECOMMENDED THAT YOU PROVIDE DOCUMENTATION FOR
THE LAST THREE MONTHS TO SHOW CONTINUOUS PHYSICAL PRESENCE.
- PHOTOS: Submit two passport photos. For your

- If you have a Criminal History:
Suggested Plan of Action Contact
the clerk at the courthouse that handled your case, and establish what you were
charged with and how the charge was resolved. In most States, the court will issue
a certified document called a Certified Court Disposition. This document will detail
the necessary information.
- For an additional fee of $50 arrange to fax, mail or email the Certified Court Disposition
to our law offices for attorney review.

will create an obstacle with US Immigration.
- If you have a Deportation Order:
Suggested Plan of Action Obtain
a copy of your deportation order.
- For an additional fee of $50 arrange to fax, mail or email the deportation order
to our law offices for attorney review.

with US Immigration.

I sponsored a family member and the petition was approved by Immigration; the visa
number is not yet current. What can I do?
|
|
There are currently no additional visa numbers being issued to Haitians; so the
wait period remains the same. We urge you to contact you local Congressman to ask
that these visa numbers be made immediately available to your relative.

I am a Haitian Citizen who arrived LEGALLY in the United States after January 12th
2010. Can I apply for TPS? What are my options?
|
|
You are not eligible to apply for TPS – the cut off date is January 12th 2010. You
may be able to extend your visitor visa on humanitarian grounds but this may not
give you the right to a work card. We urge you to contact your local Congressman
to review your unique situation.
